1. Acceptance

These Terms of Use govern access to TBCenter and related online Services operated by Florida Center for Capoeira LLC. By creating or using an account, you agree to these Terms. If you register a child, you represent that you are the child's parent or legal guardian or otherwise have authority to act for the child.

If you do not agree, do not use TBCenter. The Privacy Policy explains our information practices and is incorporated by reference for informational purposes.

2. Separate Agreements

These Terms govern use of the application. They do not replace any liability waiver, membership agreement, purchase terms, payment authorization, event release, or other document presented for separate acceptance.

If a conflict exists, the more specific signed agreement controls the subject it addresses. A recurring membership is governed by the version of the membership agreement accepted during purchase. Participation is subject to the applicable signed waiver.

3. Accounts

You must provide accurate, current information, protect your credentials, and promptly notify us of suspected unauthorized use. You may not share credentials in a way that permits unauthorized access or impersonate another person.

Parents and guardians are responsible for information and actions submitted for children they manage. Child access, when offered, is limited by the permissions established by the parent, guardian, or authorized administrator.

4. Eligibility and Program Access

Classes, programs, plans, and packages may be limited by age group, participant, location, schedule, capacity, prerequisites, membership status, or other disclosed criteria. Displaying an option does not guarantee eligibility or availability. Administrators may correct an erroneous assignment while preserving applicable signed and payment records.

You are responsible for keeping dates of birth, emergency contacts, medical limitations, injuries, and other safety information accurate.

5. Purchases and Memberships

Prices, billing frequency, renewal, included benefits, class limits, discounts, refunds, freezes, cancellations, expiration, and notice requirements are governed by the information and agreement shown during the applicable purchase.

Recurring charges are processed only under the applicable payment authorization. Stripe or another disclosed provider may process payments. Failed or disputed payments may restrict benefits or access as permitted by the applicable agreement.

A displayed price or description that is clearly erroneous may be corrected before fulfillment. We will not retroactively alter an accepted price or signed term except as permitted by the governing agreement and law.

6. Cancellations, Freezes, and Refunds

Cancellation, freeze, and refund rights depend on the applicable membership or purchase agreement. TBCenter may facilitate a request, but submitting a request does not change its effective date or contractual result unless confirmed under the governing agreement.

The currently approved operational cancellation calculation for applicable requests uses 14 days' notice. This statement does not independently add that rule to an agreement that does not contain it and does not authorize an undisclosed fee.

7. Waivers, Health, and Safety

Capoeira and related physical activity involve inherent risks. Participation requires the applicable waiver. TBCenter is an administrative platform and is not a medical or emergency service.

You are responsible for deciding whether you or a child may safely participate, seeking medical advice when appropriate, following safety instructions, and disclosing relevant limitations or injuries. In an emergency, contact emergency services.

8. Electronic Communications and Signatures

You consent to receive electronic records and transactional communications related to your account, purchases, memberships, schedules, safety, and signed documents. Where permitted, typing a name, checking an acceptance box, and submitting a document constitute an electronic signature.

You are responsible for reviewing the full version displayed before acceptance. TBCenter records the applicable version and a snapshot of signed documents where supported.

9. Acceptable Use

You may not:

  • Attempt unauthorized access or bypass permissions;
  • Interfere with security or operation;
  • Upload malicious code or fraudulent information;
  • Scrape, copy, or misuse participant or business data;
  • Impersonate another person;
  • Harass users or staff;
  • Use the Services unlawfully; or
  • Reverse engineer the Services except where law expressly permits it.

10. Intellectual Property

TBCenter, its design, software, text, branding, and business content are owned by Florida Center for Capoeira LLC or its licensors and are protected by applicable law. You receive a limited, revocable, nontransferable right to use the Services for their intended purpose. No ownership rights are transferred.

"Google," "Stripe," and other third-party names remain property of their respective owners.

11. Service Changes and Availability

We may maintain, secure, correct, or improve the Services. We will not use a software change to silently rewrite a signed agreement. Service may be interrupted by maintenance, security needs, provider outages, or events outside our control.

We may suspend or restrict access for suspected compromise, misuse, legal requirements, archived accounts, or loss of authorization. Retained records and existing contractual obligations may continue after access ends.

12. Disclaimers

To the extent permitted by law, the Services are provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation. TBCenter does not provide legal, medical, tax, or financial advice.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

13. Limitation of Liability

To the maximum extent permitted by law, Florida Center for Capoeira LLC and its owners, personnel, and providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services.

Any limitation applicable to physical participation is governed by the separately signed waiver. Nothing in these Terms limits liability that cannot legally be limited.

14. Indemnification

To the extent permitted by law, you agree to be responsible for claims and costs arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person's rights. This does not apply to the extent a claim results from our own unlawful conduct.

15. Governing Law and Disputes

These Terms are governed by Florida law, without regard to conflict-of-law rules. Subject to any controlling law or separate signed dispute provision, disputes concerning the Services will be brought in an appropriate state or federal court serving Hillsborough County, Florida.

Before filing a claim, the parties are encouraged to contact each other and attempt a practical resolution.

16. Changes

We may update these Terms prospectively. Material changes will be identified by a revised date and, when appropriate, additional notice or renewed acceptance. Updated Terms do not retroactively rewrite a signed waiver or membership agreement.

17. General Terms

If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not transfer your account or rights without permission. These Terms and incorporated policies constitute the agreement concerning use of TBCenter, except for separately accepted documents.
